The agreement
These terms are between you, the business using Regulars, and us. Using the service means you accept them. If you are agreeing on behalf of a company, you are confirming you can do that.
Regulars is built for small, independent food and drink businesses: a single shop or a handful of sites. It is priced for that, and the fair-use limits below reflect it.
The trial and what you pay
- Every account starts with a 30-day free trial with all features enabled.
- We take a payment card at signup and charge nothing until day 30.
- On day 30 we charge £29.99 and then monthly on the same date.
- If there is no card on file when the trial ends, your dashboard locks. Your data stays exactly where it is.
- Cancel from the billing page at any time. The subscription stops at the end of the period you have paid for; we do not refund part months.
- If we change the price, existing customers get 30 days’ notice by email and can cancel before it takes effect.
Your customers’ data
You are the data controller for your customers. We are the processor. That means you are responsible for having a lawful basis to hold their details and to message them, and we are responsible for keeping the data safe and only using it to run the service. Our privacy policy sets out the detail.
You must not upload customer data collected somewhere else without their consent, and you must not use Regulars to send messages to people who have not opted in.
Fair use
- Customers are unlimited. There is no cap on how many customers you add, and no per-customer fee.
- Email is included and unmetered up to a fair-use limit of 50,000 emails per shop per month. If you go past it we may slow the extra sends and get in touch, rather than cut you off.
- SMS is a paid extra, charged separately, because texts cost far more than email to send.
- The plan is for independent businesses. Very large or fast-growing operations that go well beyond typical small-business use may be asked to move to a custom plan; we will always talk to you first.
Acceptable use
- Do not use the service to send unsolicited marketing.
- Do not attempt to gain access to another shop’s data.
- Do not resell the service without a written agreement.
- Do not use it for anything illegal. We will cooperate with lawful requests.
Reviews
The review-request feature asks every customer and links straight to your public review page. Using it to solicit only positive reviews, or to filter customers by sentiment before asking, breaks Google’s policies and is not something the product supports.
Availability
We aim to keep the service running all the time and we do not promise it. The staff device is built to keep working through an outage on either side, which is the practical protection. We give notice of planned maintenance where we can.
Liability
Nothing here limits liability for death, personal injury or fraud. Otherwise, our total liability in any twelve-month period is limited to the fees you paid us in that period. We are not liable for lost profits or lost business.
Ending it
You can cancel whenever you like. We can end the agreement with 30 days’ notice, or immediately if these terms are seriously breached. Either way you can export your data first, and we will help if you ask.
